Vibeesta Copyright Policy
Protecting original expression, supporting campus creators, and adhering to Indian intellectual property legislation.
Purpose and Scope
This Copyright Policy governs intellectual property compliance on all services, mobile applications, and web domains operated by Vibeesta Networking Private Limited. Vibeesta is a user-generated-content platform connecting university and college students. Users may share original videos, photographs, audio-visual clips, campus updates, and multimedia posts, including short-form videos with embedded audio published to Vibeesta Scrolls.
Vibeesta respects the exclusive rights of copyright owners, songwriters, recording artists, record labels, visual artists, and photographers under the Indian Copyright Act, 1957, the Copyright Rules, 2013, and the Information Technology Act, 2000. This policy outlines how copyright owners can report alleged infringement, how Vibeesta evaluates notices as an intermediary, how uploaders may contest restrictions, and how repeated infringements are addressed.
Rights, Music & Platform Permissions
Users are required to possess all necessary rights, licences, or statutory authorizations for any content they upload or distribute on Vibeesta. To prevent copyright violations on campus feeds, users must understand the following essential principles:
A track available on Instagram, YouTube, TikTok, or Spotify is licensed specifically for that service's catalog. That licence does not automatically grant permission to download and post that music on Vibeesta.
Stating "All credit to the original singer" or "No copyright infringement intended" has no legal effect. It does not replace a valid licence from the copyright owner or licensing society.
Note on Background Audio & Fair Dealing: Not every clip featuring incidental background sound automatically infringes copyright. Context matters: background music captured unintentionally during live campus events or clips created for genuine commentary, criticism, or review may be protected under fair dealing exceptions (Section 52 of the Copyright Act, 1957).
How to Submit an Infringement Notice
If you hold the copyright or are legally authorised to act on behalf of the rights holder, you may submit a formal takedown notice under Rule 75 of the Copyright Rules, 2013 and Rule 3(1)(d) of the Information Technology (Intermediary Guidelines) Rules, 2021.
A legally actionable notice must include:
- Full legal name, email address, physical address or telephone number of the complainant.
- Declaration of your relationship (rights owner, exclusive licensee, or authorised representative).
- Clear description of the protected copyrighted work (song title, recording artist, ISRC/registration if available, or source URL).
- The exact URL, Scroll ID, or user handle identifying the reported content on Vibeesta.
- A detailed description of the alleged infringement and specific timestamps where the work appears.
- Supporting evidence demonstrating copyright ownership or written authority to act.
- Mandatory good-faith and accuracy declarations, and an electronic signature.
Review and Enforcement Procedure
Upon receiving a complete notice:
- Verification: The notice is logged in our moderation system with a unique reference ID (e.g.
CR-20261017-XXXX). - Assessment: Our moderation team reviews the provided identification and checks whether the reported material is present and actionable.
- Content Restriction / Removal: Where appropriate or legally mandated under applicable intermediary regulations, access to the reported content is disabled or removed.
- Uploader Notice: Where feasible, the uploader is notified regarding the report and provided an opportunity to submit a counter-notice if they have valid rights.
Vibeesta does not promise automatic unverified deletion solely upon receiving an unsubstantiated accusation, nor does Vibeesta serve as an arbitrator of contested ownership disputes without competent judicial guidance.
Creator Notifications and Dispute Process
If an uploader's Scroll or post is restricted or removed due to a copyright complaint, the creator has the right to challenge the action if they believe it resulted from a mistake, misidentification, or if they have an active licence or statutory exception (such as fair dealing).
Creators can submit a Counter-Notice / Dispute through the tab below by providing their contact details, reference complaint ID, explanation of rights, supporting evidence (such as a licence agreement or proof of original composition), and a formal declaration under penalty of law.
Repeat Infringer Policy
Vibeesta maintains a documented, proportionate repeat-infringer policy. We track verified notices and prior enforcement actions against user accounts. Depending on the frequency and severity of violations:
Formal Warning
Content restriction and educational notice explaining copyright rules.
Feature Restriction
Temporary limitation on uploading Scrolls, media, or participating in public feeds.
Suspension & Account Termination
Prolonged account suspension or permanent termination of accounts repeatedly found to infringe intellectual property rights.
